Terms

Wardrobe Merchant is a resale and declutter company registered in Nigeria. An online store located in Lekki, Lagos State, Nigeria.

When you shop with us (WhatsApp, Facebook, Instagram, Website or Others), these terms apply. These terms are important and would give you helpful information. You can also send an email to our Customer Care Team – we are customer-centric and would love to give you the best experience. 

From time to time, we keep these terms and conditions updated. And we amend them often. So before you shop, remember the latest version will apply. 

By shopping with us, you confirm that you have or have obtained the necessary authority to agree to these terms and conditions, and have agreed to these terms and conditions. 

Shopping with us

To shop with us:
1) You must be an adult (not less than 18 years old) with at least 18 years of age.
2) Must have a credit or debit card that is accepted by our payment platforms.
3) You must be authorized to use the credit or debit card (e.g. it is either in your name or you have been given full permission to use it).
4) Add items of choice to the cart, input your card details and make your purchase.

Placing an Order
1) When you place an order, you will get an acknowledgement email showing the details of your purchase. 
2) We will go ahead to confirm payment was received from your card via our payment gateway. Once payment is approved, we will confirm the order for dispatch.
3) All orders are subject to availability and confirmation of the order price. Don’t worry, if there’s an issue with an order, we’ll get in touch with you.
4) Sometimes, we may need to cancel an order if we have pricing or inventory issues. We will get in touch if this happens and we will refund you or give you store credit for future purchases.
5) If this happens to you and you think we’ve made a mistake, please don’t take offence – get in touch with Customer Care and they’ll be happy to speak to you about it.

Prices and Description of Items
As a resale company, our prices are listed by the sellers. We try to make sure they are a bargain price compared to the market price. However, from time to time our staff may put the wrong size or SKU, or describe a product or promo wrongly. When we receive your order, and we notice an error we will write notify you about it, and in the end, we still dispatch it or cancel it.

If we can’t get in touch with you within 48hours, we will have to treat the order as cancelled. If it is cancelled and you’ve already paid, we will refund you the cost of the items. Prices include VAT (where applicable). Refund will not include the commission of
the payment gateway used for the transaction.

As regards delivery, you can choose to pick up or a delivery to your location option. All deliveries are doorstep. The delivery charge is calculated based on the address you inputted and varies from location to location. It will sum up as an additional charge on the cost of the product and will be clearly shown during the checkout process.

There are also charges for transactions done via the payment gateway platforms we use. It is a minute percentage commission of your purchase.

All these, when added, will then become the ‘Total Cost’ debited to your account.

Delivery

Before you check out during your order, you’ll be given various delivery options to choose from with estimated delivery time and dates depending on the delivery address.

Please bear in mind, that we use 3rd party logistics companies for all our deliveries. Although we try to meet all delivery timelines, sometimes there may be delays from their end without them reaching out to you which could be due to faulty bikes, arrests by road agencies, accidents, flood, holidays, weekend structure or bad weather. We will keep you updated as much as we can and you should be able to track your parcel’s progress.

If you’re experiencing any problems with your delivery, please let us know within 7 days of the date which your order should have been delivered and we’ll do our best to help you. You can email our logistics team with your order number to track delivery progress.

Returning an unwanted item?

You loved it and bought it. It arrived and it didn’t fit quite well with you. It could be the size or fit, and you want your money back. Don’t worry, as long as an item is still in its original condition, we can accept returns, subject to our policy. However, some items can’t be returned, like earrings or personal items where a hygiene strip or seal has been removed (e.g., swimwear, undergarments, underwear, makeup, beauty products). Please check product description and item condition before you order.

If an item is returned to us damaged, worn, torn, stained or in an unsuitable condition, we won’t be able to give you store credit or discount codes. This means we may have to keep it till you pick up, or we send it back to you (and ask you to cover the delivery costs). We can only keep the item for 5 working days. After that it will no longer be in our custody and we will not bear the cost of the item.

All returned items should be sent in their original condition and packaging where possible, including tags (e.g., shoes should be returned with the original shoe box) in order to get a store credit. However, If we ascertain a refund has to be done, we aim to refund you within 14 days of receiving the returned item.

Use of Items Purchased

If we notice that as a customer, you show an unusual pattern of returning items you have purchased, this tells us that someone is actually wearing their purchases and then returning them for us to resell again. You can’t be ordering and returning items we are reselling for other people – way more than even our most loyal Baragainista’s would order. Once this trend is noticed, we will have to deactivate the account and blacklist the associated accounts. If this happens to you and you think we’ve made a mistake, please get in touch with Customer Care and we’ll be happy to discuss it with you.

Promo Codes

We give the promo codes, affiliate codes and gift cards so that you can use to get a discount on your purchase. But don’t forget, it is up to you to enter the code at checkout!

Each Promo Code has its terms and conditions. It will be made clear at the time it’s issued to you. They are usually limited to a timeline, date of purchase, product category, single/multiple use etc.

If you’re given a unique Promo Code that is meant just for you, please keep it secret and don’t let anyone else use it or abuse it (e.g. don’t post it on social media). Once we notice there has been a misuse of a Promo Code in any way (e.g. selling it or sharing it with others), we will cancel, modify or suspend the Promo Code and possibly close your shopping account and notify you of our action. 

Shopping Ethics

Do not misuse or tamper with our websites, apps or other services (“Websites”) (e.g. hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc) or otherwise. Neither should you tamper with our technology platforms or functionality or steal ours or our customers’ data. Doing any of these things is a criminal offence, and as well also get in the way of us giving our loyal WM Bargainista customers the best service. We will report any such breach or activity (and all information about the people carrying it out) to the relevant regulatory authorities.

We recommend you use virus protection software when using any website, including ours. Although we have a dedicated team who work hard to stop people from causing chaos with our Website, we can’t guarantee that it will always be secure from bugs, viruses or trouble-makers. You are also not allowed to use automated systems or software to extract data from our Website (AKA ‘screen scraping’).

Please take note: you agree to indemnify, defend and hold harmless Wardrobe Merchant, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this Website or your breach of the Terms and Conditions.

Intellectual Property Rights

Wardrobe Merchant owns or has permission to use the intellectual property rights in its Website and its content. These rights are protected around the world. All such rights are reserved.

You’re allowed to store, print and display our Website content only for your own personal use. You are not allowed to use any part of the Website for commercial purposes unless you have our express permission.

You’re also not allowed to use the Wardrobe Merchant trademark, contents and other intellectual property displayed on the website without our permission in writing.

Third-Party registered and unregistered trademarks or service marks on our website are the property of their respective owners and we do not endorse and are not affiliated with any of the holders of any such marks and as such we cannot grant any license to the use or otherwise of third-party intellectual property.

Legal

We have the right to amend, remove or vary our services and/or any part of the Website (including our Ts&Cs) at any time. These terms and our dealings with you are subject to the Nigerian law and the exclusive jurisdiction of the Nigerian courts.

User Generated Content: Ts&Cs

Have we reached out to you on social media to feature your content on our social media channels? Or you tagged us? Or used our hashtag to share your purchase? Congrats! It means we love your style and can re-share your content to our audience.

By giving you the opportunity to feature your content on our social media channels and by responding with the required hashtag (such as #WardrobeMerchant) you agree:

  1. We can use your handle and the content (the “Content”) on Wardrobe Merchant.com, and/or on any of Wardrobe Merchant’ social media platforms (including but not limited to Instagram, WhatsApp, Facebook and Twitter).
  2. We can edit, crop, adapt, enhance or modify the Content (but Wardrobe Merchant will not treat you in a derogatory manner).

You promise that you:
have the permission of everyone in the Content; have the right to grant Wardrobe Merchant the above rights; and that you are at least 18 years of age.

If you (or anyone in the Content) asks us to remove the Content, we will only remove the Content from our social media accounts that we control if they go against the point s above.

You understand that other users of these social media platforms can also share and make use of the Content once posted.  In particular, a user of these platforms can take a screenshot of and save an image of the Content to their device, share the Content on social media platforms or websites which feature the Content (and sharing capabilities). If you do not want to grant the permissions set out above then please do not tag us, use our hashtags, shop from us, share your purchase from us, or consent to use the Content.

Data Privacy

You agree to processing of your personal data in accordance with the terms of Wardrobe Merchant’s Privacy Policy. Wardrobe Merchant shall process all personal data obtained through the website in accordance with the terms of our Privacy Policy.
